The DOT 391 Driver Qualification File — what to include
A DOT compliance audit will pull 10 random driver files and check every page. If one driver is missing one document, the violation is on the carrier — not the driver. Here is the full 2026 checklist.
The 11 documents 49 CFR 391 requires
Driver's application for employment (391.21), inquiry to previous employers covering 3 years (391.23), inquiry to state agencies for the driving record (391.23(a)(1)), the actual MVRs received, the road test certificate or equivalent (391.31), the medical examiner's certificate (391.43), the National Registry verification, the certification of compliance with driver license requirements (391.27), annual review of driving record (391.25), the driver's safety performance history records, and the Clearinghouse query consent + result.
Each document has its own retention requirement. The application is retained as long as the driver is employed, plus three years. MVRs are retained for three years from the date of the inquiry. The medical card is replaced when expired but the prior cards are kept for three years.
The Clearinghouse piece that trips up most carriers
Since January 2023, the FMCSA Clearinghouse requires a full pre-employment query (not the limited query) before a driver can perform safety-sensitive functions. The result must be on file before the driver moves the truck.
Annual queries are required for every CDL driver every 12 months. A missed annual query is a Critical violation in an audit. The single most common DQF violation we see is a lapsed annual Clearinghouse query — usually because the carrier was tracking it in a spreadsheet that nobody updated.
How to build a DOT-audit-ready DQF in under 30 minutes per driver
- 1
Start the application electronically
Use a digital application that captures the 3-year employment history with no gaps. Gaps over 30 days require a written explanation.
- 2
Order MVR + PSP at offer
Order the MVR from every state the driver held a license in for the prior 3 years, plus PSP from FMCSA. Don't wait until after orientation.
- 3
Run the pre-employment Clearinghouse query
Must be a full query (not limited) with the driver's consent on file. Receive and file the result before the driver dispatches.
- 4
Verify previous employers
Contact every DOT-regulated employer in the prior 3 years per 391.23. Document the date of contact and the responder.
- 5
File the medical examiner certificate + National Registry check
Verify the examiner on the National Registry before filing the medical card. An expired examiner certificate invalidates the medical card.
- 6
Schedule the annual review + annual Clearinghouse query
Set automated reminders 30 days before each due date. A missed annual is a Critical violation.
Frequently asked questions
How long do I have to keep a driver qualification file?
While employed plus three years after the driver leaves. MVRs and annual reviews specifically are kept three years from the date created.
Do I need both PSP and the Clearinghouse query?
Yes. PSP is the driver's safety performance history (inspections + crashes). The Clearinghouse query covers drug & alcohol violations. They are separate FMCSA requirements.
Can I store the DQF electronically?
Yes. 49 CFR 390.31 explicitly allows electronic storage as long as the documents are legible and producible during an audit.
